Trial prep

Witnesses and their prior statements, examination outlines, an elements-of-proof matrix and a draft exhibit list.

Open the case and go to Trial prep (under Prepare). It has three views: Witnesses, Elements of proof and Exhibits.

Witnesses

The witness list is built automatically from everyone quoted in the processed documents. Click a witness to see each of their statements across the file, with the source of each.

If the same person appears under different names, select the names and use Move selected to… to combine them with another witness, or Split out to make them a separate person. Reset puts the automatic list back.

Find inconsistencies checks a witness's statements for ones that can't both be true: statements that contradict their own earlier account, and statements contradicted by the record. It uses one analysis.

Examination outlines

For any witness, choose Cross (an adverse witness: leading questions in chapters, then impeachment) or Direct (your witness: open questions, exhibits to walk through, and weak spots to address first), then click Draft cross outline or Draft direct outline. Every question cites the statement it rests on.

A draft uses one analysis, or two if the witness hasn't been checked for inconsistencies yet, because that check runs first.

Elements of proof

  1. Confirm the claims. Case Insight360 proposes claims and their elements for the case's practice area. You can rename claims, add or remove elements, add a claim from the list, or go back to Use the default for this practice area. Click Save claims.
  2. Click Build the matrix. It reads the whole file and maps the evidence for and against each element, and the gaps. A full case takes a minute or two and uses one analysis.

When the claims or documents change, the matrix says so. Click Regenerate to rebuild it.

Exhibits

A draft exhibit list of the processed documents, with dates, page counts and optional Bates ranges. Sort it By date or By type, or arrange it yourself (Custom). Move documents up or down, or leave one off the list. Bates ranges are numbered on the list from each document's page count; the documents themselves aren't stamped.

The exhibit list doesn't use an analysis.

Exporting

On Pro and Pro Unlimited, outlines, the elements-of-proof matrix and the exhibit list download as editable Word (.docx) files.
